By making a booking with Us through this website or otherwise, you agree to the following terms and conditions.
We have some standard rules that are designed to ensure that we comply with regulations relating to matters such as fire, health and safety, and to enhance the comfort and wellbeing of our guests. If you would like to check our conditions of stay please contact us. We reserve the right to terminate Your Booking immediately without being liable for any refund or compensation where You engage in unacceptable behaviour that causes a disturbance or nuisance to other guests or our neighbours.
'Yew Tree Cottage Westow' (Us/We) Terms of Business are as follows: These Booking Terms apply to the business named above (under the Booking with section of the Booking Confirmation and the Provider Information in the confirmation email) our officers, employees and agents () and the person or legal entity making the Booking or to whom We supply services in respect of the Booking (You/Your/Party Leader). These Booking Terms are governed by English law and apply to all Bookings except where We agree in writing other terms.
Pets. NO pets are allowed to be brought to the property.
Children. Children are very welcome.
Smoking. The property is strictly NON-smoking.
Length of Stay. The cottage can be booked for a minimum of 3 nights and a maximum of 21 days (subject to availability). For bookings of 2 weeks or more, an additional £40 will be charged for a mid week clean.
Bookings. Bookings are made and a contract between You and Us comes into effect when We accept a reservation from You. We will accept a reservation when We have confirmed Your reservation and received full payment of the total price quoted from You or in the event that we require a non-refundable deposit, when we have received full payment of the total value of the non-refundable deposit. You, as the Party Leader, must be able to enter into a legally binding contract and be over 18yrs to make a Booking. The party leader must be authorised to make the booking on the basis of these Booking Conditions by all other members of the party. By making the booking, the party leader confirms that he/she is so authorised and that all other party members agree that the booking is subject to these Booking Conditions. The party leader is responsible for making all payments due to us.
Methods of payment.We accept payment via Maestro, Solo, VISA Electron, VISA and MasterCard, PayPal, cheque or bank transfer.
Payment and Deposits. Bookings made through our online booking system are provisional until confirmed by Us. The total amount payable to confirm the Booking is quoted as part of this booking. Payment needs to be received within 3 days of the Invoice Date. Bookings must be paid for using an acceptable and valid credit or debit card, bank transfer, PayPal or by sending a sterling cheque to us. When you book you should pay the deposit or full amount then due(plus any insurance premiums payable) by debit or credit card, or by sending a sterling cheque to us. The balance must be received by us no less than 10 weeks before the start of your arrangements. However, if you book less than 10 weeks before the start of your arrangements, full payment of the total cost(including any insurance premiums) must be paid at the time of booking. For any accommodation booked less than 2 weeks before departure your booking must be paid for in full by debit or credit card, or by bank transfer, at the time of booking. If any payment due in relation to your booking is not paid by the appropriate date, we are entitled to assume that you wish to cancel your booking. In this case, we will be entitled to keep all deposits paid or due at that date. If Credit Card or PayPal payments are to be made, You are required to pay the commission charges in addition to the current published rate of the property. This will be stipulated on checkout of your booking. When a Booking is confirmed, a reservation number is given. This number must be retained for access to the Booking details if cancellation or amendment is necessary.
Prices. All published rates include VAT where applicable (and local taxes) at the current rate.
Rates are for the length of the stay You selected (eg 3,4,7 nights). If You have selected supplements they will be added to the total price of the Booking. Rates do not include other costs you may choose to incur during Your stay (unless otherwise stated). If additional useage is required, payment will need to be covered by You. Rates quoted are correct only for the specific number of guests, nights and dates shown. Should You change the number of guests, dates or nights, then the rates are subject to change.
Utilities. Utilities are included in the rental rate. However, you must ensure that all lights, and heaters are turned off when you are not in the cottage. Wood is also supplied. Never leave a lit fire unattended and always ensure the fire is out when you are not in the cottage.
Telephone.Telephone charges will be billed at cost at the end of your stay. A full breakdown will be available after your stay.
Sundries. A number of services can be organised on behalf of Us. We are merely acting as a booking agent for all Services booked through Us. Your contract will be between you and the Service Supplier offering the Optional Extras and will be subject to their terms and conditions in addition to those set out here. We accept no responsibility for the quality of these services, and any disputes will need to be taken up directly with the service supplier. All additional goods and services purchased during your stay must be paid in full on presentation of invoice at check-out.
Internet Access.Internet access is included in the cost of the property. WiFi details will be provided when you arrive. Internet is available on a fair usage policy. You should not use the internet to download movies, music etc. If you do any of these, you will most certainly exceed the download limit and incur an additional charge will be incurred by You to Us. If, for any reason, we are unable to supply internet, eg, for a technical reason to do with the provider who supplies internet to us, or due to a fault with our equipment, we will not be liable for any loss you incur as a consequence of not being connected. You will not be entitled to any refund of your booking fee as a consequence of not having internet during your stay.
Double booking.We take every care to avoid double bookings. However, we have several mechanisms for taking bookings including online bookings. Occasionally double bookings occur where we agree to a booking and then a subsequent booking is inadvertently processed prior to the first mentioned booking being entered into our system. In such a case, the booking first agreed to takes preference and the latter booking will be cancelled. We will not be liable under such circumstances.
Check In / Arrival. Check-in times are specified on your booking confirmation and are usually from 4pm onwards. Note, we make every effort to ensure apartment is prepared for check-in by 4pm. However, unfortunately from time to time exiting tenants fail to comply with the requirement to check-out by 10am. Where this occurs, as a matter of practical reality we may need to delay the check-in time to allow time to properly prepare the apartment after the late check-out. Please contact Us to inform approximately what time you will be arriving to provide details of how to collect the keys.
Check Out / Early Departure. The Check-out time is also specified on your booking confirmation and is usually 10:00am. Late checkout may be available and is dependent on availability. Please contact Us if you wish to extend your check out at least 4 days before your departure. You will not be entitled to any refund for vacating prior to the departure date set out in your booking confirmation.
Amendments and Cancellations.To amend or Cancel Your Booking, call or email Yew Tree Cottage Westow directly using the details contained within the booking confirmation.
If, you wish to change any detail of your confirmed booking we will do our best to make the changes, provided that notification is received in writing (or email) by You. However, we cannot guarantee that we will be able to meet any such request. Please note that changes to your dates or accommodation may be treated as a cancellation of the original booking and hence be subject to cancellation charges.
(ii) Full Cancellations
If you have to, or wish to, cancel your booking, the party leader must telephone us on the number shown on your booking confirmation as soon as possible. The day we receive your telephone notification of cancellation is the date on which your booking is cancelled.
Depending on your reason for cancellation, you may receive a refund of all monies you have paid to Us for your booking (excluding all booking fees and, and credit card charges you have already incurred. We will also retain a cancellation administration fee of £35 per week or per part week per booking.) Please note: The refund provisions referred to above only apply if the cancellation applies to all members of your party. All prices are for the entire property and not on a per person basis.
In order to qualify for a refund your reason for cancelling must be one of the following, must apply to a member of your party, and with the exception of pregnancy must have occurred after your booking and must prevent you from taking your trip. Please note that you will not receive a refund for pregnancy where the party member is expected to give birth within 14 weeks of the arrival date home. Illness/Pregnancy (subject to medical evidence of unfitness to travel); Death; Redundancy (provided employment has been on a continuous basis with the same employer for at least 2 years); Jury or Witness service (in a Court of Law); Illness or Death of a close relative (a close relative is defined as one of the following - Spouse, Son or Daughter (in law), Parent (in law), Grandparent, Sister or Brother, Fiancee; your home is rendered uninhabitable due to fire, storm, flood, subsidence or malicious damage; your presence is requested by the Police, following a burglary at your home or place of business, during the period of your holiday or within the preceding 7 days; your unexpected posting by HM Forces or cancellation of leave by HM Police (unless the cost of the lost holiday is recoverable from any other source); or compulsory quarantine. You may also receive a full refund if you are unable to reach your holiday destination due to snow or flood conditions or as a result of being involved in an accident en route (NB: This only applies if you have made every effort to attempt to complete your journey. You will need to produce evidence from the Police, RAC or AA). Although a refund is available in these circumstances you may prefer to delay your arrival. In these cases a 25% refund is available for each 24 hour delay, up to a maximum of 72 hours = 75% (For short breaks, a fixed refund of 50% applies for all arrivals delayed for more than 24 hours). You will be asked to complete a Booking Cancellation form which may require signing by a Medical Practitioner or employer and in which we may request further information from a third party.
The following reasons for cancellation do not qualify for a refund as set out above: suicide or attempted suicide, intentional self-injury, the effect of intoxicating liquor or drugs, or any other reason which is not specifically referred to.
Where the reason for cancellation does not fall within one of the qualifications for a refund as set out above, eg: dis-inclination to travel, leave cancelled by employer (other than HM Forces or the Police) etc, a cancellation charge will be payable, based on the number of days before the arrival date at the property that we receive notification of your cancellation, as shown in the following table. This means that if you have paid the balance of your total accommodation cost and then have to, or wish to, cancel, you may receive a refund of part of such cost. However, if you have not paid your total accommodation cost including any booking fee by the time of your cancellation, you may be required to make a further payment by way of cancellation charge. For the purpose of the table below, Accommodation Cost means the total cost of the accommodation booking, including any extra items. Any booking fees, credit card charges and administration fees for making any changes will still be payable in full by you.
Please note that, where already paid, booking fees, credit card charges and administration fees are not refundable in the event of your cancellation.
Cancellation Charges. We recommend that you take out travel insurance to cover you for unforeseen circumstances which may cause you to cancel last minute. Below are the number of days before the start date of your arrangements that notification of cancellation is received by us and the corresponding Cancellation Charge (plus all booking fees, credit card charges or administration fees payable by you)
More than 70 days - Full Deposit (including any Balance of Deposit due)
29 - 70 days - 50% of Accommodation Cost or Full Deposit (including any Balance of Deposit due), whichever is the greater.
15 - 28 days - 75% of Accommodation Cost
14 - 49 hours - 90% of Accommodation Cost
Within 48 hours of the scheduled check-in-time - No refund.
(iii) Curtailment of your stay
A refund as set out above is also available if your stay is cut short for any of the qualifying reasons set out in (ii) above. In this case, you will be reimbursed for the appropriate proportion of the cost of your stay. This only applies if the property is vacated by all persons in your party. Where your stay is curtailed for medical reasons affecting any persons in your party, you will need to produce a certificate from a local doctor, confirming the necessity of returning home.
(iv) Partial Cancellations
Where only part of your party needs to cancel this will not normally affect the total cost of your booking unless any travel arrangements or additional services which are charged on a per person basis are cancelled. In these instances any such per person charges paid will be refunded after deducting any cancellation charges made by Us.
(v) Cancellations or changes made by Yew Tree Cottage Westow
We do not expect to have to make any changes to your booking, but sometimes problems occur and bookings have to be changed or cancelled or errors in brochures or other details corrected. We reserve the right to do so. If this does happen, we, will contact You, the party leader (by telephone where reasonably possible in the case of a significant change or cancellation; minor changes will be notified by email) as soon as is reasonably practical, explain what has happened and inform you of the cancellation or change.
(vi) Force Majeure
Except where otherwise expressly stated in these Booking Conditions, we, regret that we can not accept liability or pay any compensation where the performance or prompt performance of the obligations under your Booking Terms and Conditions by Us is prevented or affected by or you otherwise suffer any damage or loss as a result of "force majeure. In these Booking Conditions "force majeure means an event beyond the reasonable control of the Owner and/or us which we or the Owner in question could not, even with all due care, foresee or avoid including, but not limited to strike, lock-out, labour dispute, act of God, acts of terrorism, war, riot, civil commotion, malicious damage, compliance with a law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, insolvency or bankruptcy of an Owner, fire, flood, snow and storm, difficulty or increased cost in obtaining workers, goods or transport and other circumstances affecting the supply of goods or services.
Security Deposit. At our discretion we may require a security deposit of up to £2000 prior to commencement of your stay. The full cost will be determined on date, season and length of stay and communicated to you at the time of your booking. The security deposit will be refunded by Us at the end of your stay (less any costs for breakages, damage etc if applicable). This will be within 14 days of your departure. You and all members of your party agree to keep the property clean and tidy, to leave the property in a similar condition as you found it upon your arrival, and to behave lawfully at all times whilst at the property. You and all members of your party further agree not to use the property for any unlawful or commercial purpose, including without limitation assigning or subletting it or otherwise allowing anyone to occupy it who has not previously been accepted by Us. You are responsible to Us for the actual costs of any breakage or damage in or to the property - along with any additional costs that may result - which are caused by you and/or any members of your party, We can require payment from you to cover any such costs, and broken items will require a like for like replacement. Any call out charges, and repair costs to services in the property will be payable if the fault is due to You or your party.
We are entitled at our sole and absolute discretion to refuse to hand over to you, or to repossess, the property if We reasonably believe you or any member of your party is behaving unlawfully, or that any damage is likely to be caused, has been caused or is being caused by the behaviour of you or any members or your party. These circumstances will be treated as a cancellation by You. You also must not allow more people than stated to occupy the property, neither can you significantly change the composition of your party during your occupation of the property. If you do any of these things, We can refuse to hand over the property to you, or can repossess it. If this does happen, this will be treated as a cancellation by You. In these situations no refund of any monies you have paid in respect of your booking will be made and We will not have any liability to You as a result of this situation arising (including for example any costs or expenses you incur due to not being able to occupy the property, such as the cost of securing an alternative property/ accommodation or the payment of any compensation to you). We are not obliged to find any alternative accommodation for you. You must allow Us and any representative (including workmen) access to the property at any reasonable time during your occupation of the property (except in cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time - in these situations We are entitled to enter the property at any time without giving you prior notice).
Damage. You authorise us to recover from you any loss we incur as a consequence of damage caused by you or your guests to the property, services at the property or the interiors and furnishings in it. If you have provided credit card details to us, you authorise us to deduct up to £1,000 from your credit card for this purpose
Liability. Other than for death or personal injury caused by Our negligence or misrepresentation, Our total liability to You is limited to the price of the Booking and to the fullest extent permitted by law all warranties are excluded and in no circumstances will We not be responsible for any indirect or special damages. We will not be liable for failure to perform to the extent that the failure is caused by any factor beyond Our reasonable control. You are responsible for any damage or loss caused to Us or our Our property by Your act, omission, default or neglect and You agree to indemnify Us and to pay Us on demand the amount reasonably required to make good or remedy any such damage or loss.
Data protection.We may process the information You provide to Us for the purposes notified by Us to the Information Commissioner. By making a Booking, You consent to this processing of information. If you have provided an e.mail address as part of booking a property, you are deemed to have received any e.mail sent by us to that address. Sending an e.mail to that address is deemed proper notice by us.
Acts of god. If your property is made unavailable as a consequence of an act of god, eg, a flood, you will not be entitled to a refund of your booking fee. You should ensure you are covered for this by your travel insurance
Cleaning during your stay. The standard price does not include providing cleaning services during your stay. We can, however, arrange this for you. The cost to you is £95 per clean. This includes a standard clean and linen change.
Luggage. As we do not have a physical reception, we are not able to store luggage for you proir to your check-in time or after you check-out.
Travel Insurance. We recommend that you take out adequate travel insurance to cover you for the duration of your stay.
Disabilities and medical problems. If you or any member of your party has any medical problem or disability that may affect your booking please tell us before you confirm your booking and give us full details as early as possible before you travel. If We reasonably feel unable to properly accommodate the particular needs of the person concerned we reserve the right to decline or cancel the reservation.
